A design team of tobacco company develops the replacement of cigarette: the new heat-no-burn device. The idea is to reduce the harm of smoking by replacing burning (as in cigarettes) by heating. Capsulated tobacco cut is placed in the electro resistive heater, the user press the ON button and gets the first puff in 20-30 seconds.

Unfortunately, just several weeks before the product concept presentation, company lawyers find several patents of competitors with the same idea: inhaler with electric heater for tobacco cut. Could we find a way to circumvent the competitor’s patents?

We can hardly circumvent a patent by adding anything to what has been listed as system components in the patent’s claim section. But if we trim the system contents, reducing the part count, we have chances to invent new patentable design. The drama is that the in the triangle “Tobacco – Heater – Electrical energy” seems to be the simplest configuration to ensure heating. Let us trim the heater and think how tobacco can be heated. Physics says that tobacco can be the electro resistive heater itself. Indeed, quality tobacco cut contains certain amount of moisture and salt that makes it electrically conductive. Thus, we can just pass the electricity directly through the tobacco mix. And if we want to make the process more reliable and controllable (the conductivity reduces as the temperature raises) we can add to the tobacco certain amount of graphite particles, that have no smell, tasteless, cheap and perfectly conductive.
